The Agreement

1. The Owner hereby gives CARIBBEAN PROPERTY BROKERS an Exclusive right to sell the above Property, including structures on the Property, for a period of One Year from the date and time of signature below.

2. CARIBBEAN PROPERTY BROKERS will be paid a Fee of __________ percent (____ %) of the Total Purchase Price in the event that CARIBBEAN PROPERTY BROKERS provides a buyer that is ready, willing and able to purchase the property at the agreed terms as listed above. The Full Commission Fee will be due at the closing of the sale.

3. This Agreement will expire at 12:00 Midnight on _________________, 365 days from the date of this Agreement. CARIBBEAN PROPERTY BROKERS will be due a commission on the property being sold to any person or business entity introduced to the property by CARIBBEAN PROPERTY BROKERS during the One Year listing period, valid for a further period of One Year.

4. The Owner understands that, although CARIBBEAN PROPERTY BROKERS cannot and does not guarantee sale of the Property, CARIBBEAN PROPERTY BROKERS will make every reasonable effort to do so until either the Property is sold or this Agreement expires.

4. CARIBBEAN PROPERTY BROKERS will be due a commission on the property sale to any person or business entity introduced to the property after the listing expires in the event that the owner allows CARIBBEAN PROPERTY BROKERS to show the property and agrees to the property sale to said person or business entity.

5. The Owner represents that any information given to CARIBBEAN PROPERTY BROKERS by the Owner is true and accurate and that CARIBBEAN PROPERTY BROKERS will rely upon such information when presenting the Property to potential purchasers. The price was arrived at solely by the owner.

6. The Owner will hold CARIBBEAN PROPERTY BROKERS harmless from any costs, including attorney's fees, incurred by CARIBBEAN PROPERTY BROKERS as a result of a breach of this agreement by the Buyer.

7. The owner agrees to CARIBBEAN PROPERTY BROKERS being included in all sales documentation as the registered Sales Agent or Broker responsible for the sale.

8. Deposits and funds received from the buyer will be placed in escrow with Richards Anjo and Associates, Attorneys-at-Law, St. John's , Antigua or an attorney appointed by CARIBBEAN PROPERTY BROKERS. Funds placed in escrow by the buyer will include the agreed commission of CARIBBEAN PROPERTY BROKERS. Funds will be paid out under instruction to all participating parties. The owner will receive the balance of funds once all government deductions, legal, realty and other fees have been paid.

9. Sales documents will be drawn up by Richards Anjo and Associates, Attorneys-at-Law, St. John's, Antigua, or an attorney appointed by CARIBBEAN PROPERTY BROKERS . The buyer will pay any fees related to the drawing up of the sales documentation.

10. The Attorney representing the seller and the attorney representing the buyer will review sales documentation. Review costs will be subject to payment by seller and buyer respectively.

11. The Owner allows CARIBBEAN PROPERTY BROKERS to work with other real estate agencies and brokers toward sale of the Property in a manner and method deemed by CARIBBEAN PROPERTY BROKERS to be in Owner's interest.

12. The Owner and Occupant will allow access, within 24 hours notice, to CARIBBEAN PROPERTY BROKERS for the purpose of showing the property. Alternatively keys may be left with the agent.

13. The Owner allows CARIBBEAN PROPERTY BROKERS to place a 'For Sale' sign attached to the property at a position agreed to by the Owner.

14. Any information given by the Owner can be provided to the buyer. The owner will verify any and all qualifications of the buyer and understands that CARIBBEAN PROPERTY BROKERS will not make any verifications or warranties including but not limited to the buyer's health, competency, residency and financial status.

15. All sales transactions will take place in accordance with the applicable laws and fees in compliance with the jurisdiction that the purchase takes place.

This is a legally binding contract. Please read it carefully before signing. If signing for a corporation, please indicate your capacity in the corporation.

I/We have read and understood, and hereby agree to the above terms and provisions of this contract. Also, I/we represent and warrant that I/we constitute all of the owners/partners/shareholders of the Property listed herein and hereby personally guarantee performance of this contract. By our signature we acknowledge receipt of a copy of this contract.
